The General Terms and Conditions of website www.dogoteka.si (in the following: www.dogoteka.si or Dogoteka) and e-shop  have been compiled in accordance with the Consumer Protection Act (ZVPot-1, Official Gazette of the Republic of Slovenia, nr. 130/2022). The conditions deal with the operation of the website www.dogoteka.si  and the business relationship between Dogoteka d.o.o. (in the following: Dogoteka), registered users (in the following: users) and buyers of goods or services (in the following: buyers).

By accessing, browsing or using the Site and/or its services, you represent and warrant that you are at least eighteen (18) years of age. By entering this website, you acknowledge that you understand and agree with these General terms and conditions and that they are legally binding. Dogoteka reserves the right to modify or change these General terms and conditions without any further notice and to terminate a user’s account should that user be in violation of any of the Website Policies.

2.2 License

All content included on the Site, such as images, pictures, videos, documents, drawings, figures, logos, (collectively, the “Content”), is the exclusive property of Dogoteka or its content suppliers and is protected by national and international copyright and other intellectual property laws. In the event of obvious errors in the price or essential product information that can reasonably be recognized as a mistake, Dogoteka will inform the customer without undue delay and allow the customer to cancel the order free of charge and receive a refund of all payments made or, if the customer expressly agrees, to make an appropriate change to the order. This provision does not exclude or limit the consumer’s statutory rights or Dogoteka’s liability for the truthfulness and timeliness of pre-contractual information and for the conformity of goods under ZVPot-1.

Descriptive statements regarding the properties and effects of products are based on manufacturers’ data, product documentation, and generally available information. Dogoteka strives to ensure that product photographs and descriptions reflect the actual characteristics and appearance of the goods as faithfully as possible. In the event of material discrepancies between the presentation of a product and the goods actually delivered, which could affect the consumer’s purchasing decision, Dogoteka will allow the consumer, free of charge, to withdraw from the contract and receive a refund of all payments or to have the product replaced, in accordance with applicable law, including ZVPot-1.

Subscribing to e-newsletter is governed by the General terms and conditions of e-newsletter registration, for subscribing and receiving e-newsleter and hereunder states the obligations, rights and conditions for using and managing the logged-in user’s data. 3.1 General

Welcome to the website www.dogoteka.si (Dogoteka d.o.o.), hereinafter referred to as Dogoteka.

The website www.dogoteka.si is managed by Dogoteka d.o.o., Golo brdo 3a, 1215 Medvode, Slovenia. Dogoteka’s online store General terms and conditions of sale (e-shop) are in accordance with the Consumer Protection Act (ZVPot-1), Chamber of commerce (Trgovinska zbornica Slovenije) recommendations and the International Codes for e-business. In the event of a discrepancy between the translation of the General terms and conditions of sale (eshop) accepted by the user, the Slovenian language takes president with reference to official meanings and explanations. The term “Customer” refers to the physical person making the purchase, referred to in this contract, for purposes not related to commercial or professional activity. The term “Contract” refers to the purchase agreement entered into between Dogoteka and Customer as part of a distance selling transaction. Only individuals over the age of 18 may place orders. A minor needs consent from parents or guardians.

The language in which the Contract is concluded is Slovenian. In the case of contrast between the versions of the General terms and conditions of sale (e shop), the meaning and interpretation of in Slovenian language prevail.

Access to the dogoteka.si online store is available to all users regardless of their country of access. Users from other countries may be offered the option to visit a localized website (e.g., dogoteka.it for the Italian market), but only based on their explicit choice; automatic redirection without consent is not permitted. The provider may restrict delivery to specific countries, with such restrictions clearly stated before and during the ordering process. Purchases with delivery to Italy are invoiced by DOGOTEKA SRLS via dogoteka.it.

3.2 Forming a contract

With these General terms and conditions of sale (e-shop), Dogoteka sells to the Customer, who buys remotely, the Products offered for sale on the website www.dogoteka.si (the “Site”).

The contract between the Supplier and the Customer is concluded exclusively through the Internet in remote telematics mode, through the Customer’s access to the web address www.dogoteka.si by sending a purchase order according to the procedure provided by the site itself and its acceptance by Dogoteka. The purchase order transmitted by the Customer through the Site has the value of a contractual proposal and is governed by these general sales conditions which, the Customer himself, is obliged to accept in full and without any reservation. The Customer cannot complete the order without accepting these general terms of sale.

Before the conclusion of the purchase agreement, the Customer takes a look at the characteristics of the goods that are illustrated with specific and detailed indication of their characteristics, in the individual product cards at the time of choice by the Customer. The Customer, before proceeding to the conclusion of the order, undertakes to take into account and to agree with these general conditions. The Customer is aware that in order to access the website www.dogoteka.si you need to have an Internet connection whose costs are borne by the Customer according to the terms set by your internet service provider. The sales contract is concluded at the moment when the customer places an order on the website by using the functionality / clicking the button “order with obligation to pay”. Dogoteka shall, without undue delay, send the customer an email confirming receipt of the order, containing the customer’s details, the order number, the date the order was placed, a list of the purchased products, the price of the purchased products, value added tax, shipping costs and any additional costs, the delivery address to which the products will be sent, and the method of payment. In the order confirmation email, the customer will also receive a link providing access to these General Terms and Conditions of Sale.

Dogoteka will provide, via this email, a confirmation of the concluded contract on a durable medium, which, in accordance with Article 133 of the ZVPot-1, contains in particular:

3.3 Order and availability of products

Product availability is indicated on the product page and at the time the order is placed. In exceptional cases of simultaneous purchases, a temporary stock discrepancy may occur. In such a case, an available product may be sold before your order is confirmed, as a result of which the product may become unavailable to you, for which we sincerely apologize. In this event, Dogoteka will inform the customer without undue delay and offer the customer:

  1. cancellation of the order free of charge, with a refund of all payments received without undue delay; or
  2. delivery within an additional reasonable period, if the customer expressly agrees to this; or

Dogoteka shall not be liable in the event of force majeure or any unforeseeable circumstances, such as internet errors or any technical interruptions on the part of the customer or Dogoteka, which could result in orders not being processed, subject to the time limits set out in these General Terms and Conditions.

3.4 Purchase and registration process

Dogoteka d.o.o. acts as a company that offers goods or services over the Internet.

In the store www.dogoteka.si, the user can place an order in the online store as a guest or as a registered user. The registration process is easy and fast. By logging in to the website, you create your account, through which you can edit your data, delivery addresses, view order statuses, track and edit them.

The username consists of the email address you enter. You will then receive a confirmation email for final registration. By registering on the website, you also have a greater overview of the purchase.

The buyer pays the amount to Dogoteka d.o.o., and together with the goods or services he also receives an invoice. The company operates worldwide. The package also contains a printed invoice, which the customer can also receive at the entered e-mail address.

3.5 Prices

The sales prices listed on the website include VAT and are in accordance with the National law: Method of marking the prices of goods, digital content and services and the announcement of price reductions. Prices are in euros (EUR). Dogoteka reserves the right to change, limit or terminate any special offer or discount on products at any time. Shipping costs are not included in the price of the products, but are indicated and calculated at the end of the purchase process and before payment.

Discount and promotional prices are published in accordance with the National law of marking the prices of goods, digital content and services and the publication of price reductions. In addition to the reduced price, the lowest price of the product in the last 30 days is also indicated.

If the recipient’s address is outside the Republic of Slovenia but within the European Union, the tax of the country to which the goods are sent is calculated upon purchase. The sales prices listed on the website are shown without VAT and with the VAT of the individual EU member states. Prices are in euros (EUR). Dogoteka reserves the right to change, limit or terminate any special offer or discount on products at any time. Shipping costs are not included in the price of the products, but are indicated and calculated at the end of the purchase process and before payment.

EU CUSTOMERS
In accordance with the amendment to the European VAT Directive and the VAT Act regarding distance selling (Council of Europe Directives (EU) 2017/2455 and Council Directive (EU) 2019/1995).

GOODS TAX IS CALCULATED ACCORDING TO THE TAX RATES OF THE COUNTRY OF RECIPIENT OF THE GOODS. THE TABLE OF TAX RATES OF THE MEMBER STATES OF THE EUROPEAN UNION IS FOUND BELOW.

NON EU CUSTOMERS

Customers outside the European Union make a purchase without VAT. Shipping costs are calculated for purchases up to 299.99 EUR. For purchases over 300,00 EUR, shipping is free.

Shipping cost are charged, and paid in full, together with Slovenian 22% VAT.
For non-EU countries, the cost of customs clearance, VAT and other import costs is borne by the buyer.

Company is not selling into Rusia and Iran.

3.6 Methods of Payment

The following payment methods are available:

The data transfer is encrypted, so your credit card information is secure.

Pro forma invoice:
Customers can place an order also by phone at 031 331 508 or via email. After placing the order, a pro forma invoice will be sent to their email address, which the customer can pay at the post office or bank. The proforma invoice contains all the information you need to complete your prepayment: bank account information, company information, and transfer reference number information. After the payment is completed, you can send a payment notification to: info@dogoteka.si. Your order will be held until we receive payment. After the payment is received, the product and invoice will be sent to the customer. By paying via proforma invoice, the customer agrees to the general terms and conditions.

Payment with Paypal or payment and credit cards:
If you pay with a payment, credit or debit card or PayPal, the actual debit of the order amount will only be incurred when the order is completed and ready for shipment. Dogoteka reserves the right to change the methods of payment that can be used, regardless of the methods that can be used and were published on the list at the time the customer placed the order.

Cash on delivery:

Cash payment is required upon delivery of goods via cash-on-delivery service (only in Slovenia).

Cash payment at the company’s headquarters:

Pickup of goods with cash payment is possible during the company’s business hours at the company’s address: Dogoteka d.o.o., Golo Brdo 3A, 1215 Medvode, solely and exclusively upon prior telephone notification and agreement with the staff.

3.7 Delivery

Your package will be shipped as soon as possible. Shipping times may vary from the next business day up to a maximum of 30 (thirty) days from order confirmation. Delivery by our contracted partner takes place Monday through Friday; there are no deliveries on weekends or holidays. Our contracted partner for delivery is Pošta Slovenije. The post office will deliver your goods within the agreed timeframe. You may also opt for delivery to any other name or address. If you are not at the designated location (company, office, etc.) at the time of delivery, the delivery person will leave a note; you can pick up the package at the nearest post office during business hours. If the customer does not receive the goods within a few days of shipment, they should notify Dogoteka immediately. In this case, Dogoteka will determine the cause and inform the customer. Delivery may be delayed or extended due to weather conditions, COVID-19, or technical issues with the courier service.Delivery pricelist for EU CUSTOMERS:

*Postage tax is calculated on price 12,30 eur (price without vat) according to the tax rates of the country of recipient of the goods. The table of tax rates of the member states of the European Union is found in paragraph “5. Prices”.

Delivery pricelist for NON – EU CUSTOMERS If your country is not on the above list of countries of European Union, the delivery cost is included in the purchase price as a separate item up to the amount of 299.99 EUR. Shipping cost are charged, and paid in full, together with Slovenian 22% VAT. For purchases over 300,00 EUR, shipping is free.

You can choose between sending DHL economy or DHL express, the program will determine the exact amount of shipping costs depending on the weight of the package and the shipping address. For purchases over 300,00 EUR shipping is free. For non-EU countries, the cost of customs clearance, VAT and other import costs is borne by the buyer.

Destruction of the package:

If the buyer (recipient) fails to pay the TAX and import duties, the courier service and the customs office may decide to destroy the package. In this case, a reimbursement of the purchase price to the buyer is not possible. The costs of destruction are borne by the buyer.

Delivery damage:

At the time of delivery, the customer is required to verify that the packaging is intact and not altered, even if the closing tape if present.

In the event that the delivered goods present any damage allegedly caused by the transport, the buyer may refuse the delivery and immediately notify the Supplier, who will will file appropriate objections to the transport company and provide a new shipment after returning the disputed goods received.

In case of damage to the shipment, the buyer fills in the product return form and sends it to info@dogoteka.si, where it is agreed to replace the product. The product return form is available on the following link:

3.8 Validity of the offer

Prices are valid at the time of order confirmation. All prices include VAT. Prices are subject to change without notice.

3.9 Special offers and promotions

Special offers and promotions are valid within certain time limits or until stocks are sold out within the specified period. All promotional offers are specially marked on the website and marked with the word “offer”, “product under promotion” or other equivalent names.

3.10 Contract termination rights and refund of goods

The consumer has the right to withdraw from a distance contract  within 14 days of receiving the goods, without giving reasons. The period of notice shall expire 14 days from the date on which the consumer or a third party deisgnated by the consumer, other than the carrier, acquires physical possession of the goods.

In order to exercise the right of withdrawal, the consumer must inform Dogoteka of their decision by means of an unequivocal statement (e.g., via email to info@dogoteka.si or in writing to the address Golo Brdo 3a, 1215 Medvode, Slovenia). For this purpose, the consumer may use the attached contract withdrawal form, which is available on the website and is attached to the confirmation email sent after purchase..

NOTICE OF WITHDRAWAL

Exceptions to the right of withdrawal – sealed goods for health or hygiene reasons

Pursuant to Article 135(7) of the ZVPot-1, the consumer does not have the right to withdraw from a contract for the supply of sealed goods that are not suitable for return for health or hygiene reasons if the consumer has broken the seal after delivery. This exception applies strictly and only to products that cumulatively meet the following conditions:

For products that are not marked in this way and are not equipped with an actual hygiene seal, the consumer does not lose the right of withdrawal even if they open the packaging; however, they may be liable for any diminished value of the goods in accordance with Section 3.12.

3.11 Contract termination effects

In case of the contract termination Dogoteka shall, without undue delay, but not later than 14 days from the date of the receipt of the notice of withdrawal, reimburse all payments received, including delivery charges (except any additional costs arising due to the consumer’s choice of the delivery type if this surpasses the most favourable standard delivery).

The reimbursement will be carried out in the identical manner to the original transaction with reference to the payment method, unless the consumer expressly agrees to a different method of reimbursement that does not entail additional costs for them.  Dogoteka can hold on to any payments until the goods are back-received or until the consumer provides proof of shipment of the goods back.

3.12 Refund of goods terms

The consumer must return the goods without undue delay and no later than 14 days from the date on which they notified Dogoteka of their withdrawal. The goods must be returned to the address: Dogoteka d.o.o., Golo Brdo 3a, 1215 Medvode, Slovenia.

The consumer bears the direct costs of returning the goods, unless otherwise agreed.

The consumer may handle and test the goods only to the extent necessary to determine the nature, characteristics, and functioning of the goods (as they would in a physical store). The consumer is responsible for any reduced value of the goods due to improper handling of the goods.

3.13 Reject the package

Republic of Slovenia: The consumer bears the direct costs of returning the goods.

3.14 Non-conformity of Goods (Statutory Warranty of Conformity)

Dogoteka is liable for any non-conformity of the goods that exists at the time of delivery and becomes apparent within two years of delivery (Article 80 of ZVPot-1).

When are goods non-conforming: Goods are nonconforming with the contract if, in particular:

Consumer rights in the event of non-conformity: The consumer may first request that the goods be brought into conformity (repair or replacement) free of charge within a reasonable period, which may not exceed 30 days (Article 82 of ZVPot-1). Only if bringing the goods into conformity is not possible, is not carried out within a reasonable time, or would cause the consumer significant inconvenience, may the consumer request a proportionate reduction in the purchase price or withdraw from the contract and request a refund (Article 83 of ZVPot-1).

All costs related to bringing the product into conformity (including shipping, labor, and material costs) are borne by Dogoteka.

The consumer shall notify Dogoteka of any non-conformity at info@dogoteka.si or at the company’s address.

3.15 Responsibility

Dogoteka takes no responsibility for disruptions attributable to force or fortuitousness, even if it is dependent on internet malfunctions and malfunctions, in case it fails to enforce the order on time under these general terms of sale.

The Supplier will also not be liable for damages, losses and costs incurred by the customer as a result of the non-execution of the contract for reasons not attributable to him.

The Supplier assumes no responsibility for any fraudulent and unlawful use that may be made, by third parties, of credit cards and other means of payment, for the payment of the purchased products, if it proves that it has taken all possible precautions on the basis of the best science and experience of the moment and on the basis of the ordinary diligence required.

3.16 Miscellaneous

If, after prior notice from Dogoteka, the consumer does not collect the goods that have been made available for collection or return following the conclusion of the withdrawal procedure, the handling of a non-conformity of goods, or another duly completed procedure, Dogoteka shall not be obliged to store such goods indefinitely. In such a case, Dogoteka may invite the consumer again to collect the goods and set an appropriate additional period for collection. After the expiry of that period, Dogoteka may require the consumer to reimburse the reasonable and actual costs of storage, re-delivery, or other lawful handling of the goods. Dogoteka shall handle any uncollected goods in accordance with applicable law, taking into account the nature, value, and condition of the goods. This provision does not affect the consumer’s rights under ZVPot-1.

3.17 Customer reviews on the website

At Dogoteka, we are aware that consumers rely more and more on the reviews and recommendations of other consumers when making a purchase. Dogoteka is committed to transparency in this regard and has processes and procedures in place to ensure that reviews published by Dogoteka on its website or social media come from consumers who have actually used or purchased the products. Thus, before publishing any evaluation, we check whether the person who gave the evaluation actually bought the product (e.g., by asking the person for an account number or by sending them a unique link to a webpage associated with the message, which allows only the recipient to submit a rating) or used it on any other basis (e.g., contractual relationship – promotional material). When publishing a review, we clearly state whether the relevant review was sponsored or affected by a contractual relationship, as the case may be.

We publish the reviews we receive from our customers on the website and social networks. We do not filter or select reviews based on whether they are positive or negative. All reviews that comply with our posting guidelines (i.e., are not offensive, provide an accurate description of the experience, and come from a verified customer) are published.

3.18 Conflict solving

Dogoteka strives to resolve any potential disputes amicably, through our best endeavours and in the shortest possible time. The complaints are to be submitted via our e-mail info@dogoteka.si or in writing to Dogoteka d.o.o., Golo brdo 3a, 1215 Medvode, Slovenia. The complaint process procedure is confidential. If any disputes cannot be resolved by mutual agreement or with an Out-Of-Court settlement, any disputes with consumers will have to be resolved by the court of justice with its jurisdiction in accordance with the law. For disputes with customers who are not considered consumers within the meaning of the law, the court with jurisdiction is the court in Ljubljana, Slovenia.
